Which of the following most accurately describes the problem?

aJohn Evans & Sons (Llanelli) was allowed to surrender its licence when the company appeared

before Welsh Traffic Commissioner David Dixon at a Cardiff disciplinary inquiry.

For the company, Chris Childs said that it no longer operated any vehicles and had only a warehousing business.

The company was formed in the mid-1950s and had never before been called to public inquiry. In its heyday it had oper. ated 33 vehicles but that had reduced to 25 by 1996.

The company had had an exemplary maintenance record until then and attributed its more recent prohibition notices to an ageing fleet.

The vehicles had been sold off as the drivers left and all that remained now were four trailers.

Questioned about four convictions for speed lim iter offences revealed by a check on the company's tachograph charts, director and transport manager Peter Evans said the problem should have been picked up but the person checking the charts had been concentrating more on driving hours and breaks.

Dealing with the prohibitions, Evans said one was caused by a faulty brake actuator which should have been noticed. Many of the defects could have occurred at anytime.

He was unlikely to return to the haulage business and was expecting to retire.

Evans' younger brother, David, said he had been more concerned with the warehousing me than vehicle maintenance. He held a CPC and might return to haulage after the warehouse and yard were sold or leased.

Accepting the licence surrender, the TC said that he made no finding against the repute of the Evans. Had the licence been continuing he would have considered taking some disciplinary action but to do that now would be academic.
