Which of the following most accurately describes the problem?

any purpose, having failed its annual test and what is the position if the vehicle is involved in an accident, and the fact that it failed its test a few hours previously, comes to the notice of the police?

Also, what is the legal position with regard to fitters carrying out repairs to vehicles on the motorway?

The answer to your second point is that the fact that the vehicle is involved in an accident after failing its test, presumably not on the way to a place where it is to be repaired, might convince the police that charges should be brought against the driver and the owner for using an unfit vehicle on the road.

Only repairs to enable the vehicle to be moved to a more suitable place should be carried out on the motorway. If it is possible to move the vehicle (by towing for instance) to a more appropriate place then this method should be employed.
