Which of the following most accurately describes the problem?

A FAMILY dispute in which a son "wrestled control" from his father has led to the operation's licence being revoked because it failed to notify the TC it was now a limited company.

Gloucester haulier Michael Brian Holder, who formed a limited company to take over his business without seeking a fresh licence, has had his existing licence for 12 vehicles revoked by the Western Deputy Traffic Commissioner Fiona Phillips. The company had previously been run as a sole trader. The DTC granted the company. MB Holder & Sons, interim authority to operate the eight vehicles currently in possession.

Director Michael Wayne Holder said the business had been started by his father. They had to wrestle control from him and a limited company had been formed on the advice of their accountant. Four of the vehicles were dedicated to British Telecom delivering aerials nationwide. The others were mainly used by a local timber merchant.

Vehicle examiner David Pillage said he had been concerned about the use of a mobile mechanic to maintain the vehicles as there were no maintenance facilities at the operating centre. Though there had been a number of prohibitions, including an 'S' marked one, the condition of the vehicles was quite good. The company had taken on board his concerns and maintenance was now contracted out.

Granting the interim one, the DTC said that she was only prepared to agree to eight vehicles. The company could have more if there was a satisfactory maintenance report within the next six to 12 months
