Which of the following most accurately describes the problem?

A Dumbarton haulier was using a revoked licence as a front for an unlicensed operation.

A HAULIER WHO was Mega I k operating without an 0-licence for at least 18 months has been refused an international licence for eight vehicles and 10 trailers.

The bid by Dumbarton-based KDC Storage and Distribution was turned down by Scottish Traffic Commis sioner Joan Aitken.

KDC's nominated transport manager was John Samson, and the sole director was said to be Lisa Donnachie.

However. the 'IC said that Companies House records did not include Lisa Donnachie as a director. Henry Craig was listed as a director from 1 February 2008 to 20 January 2009, when he resigned.

The remaining director was Steven Donnachie, who had also been a director of two other operations SOW and Smith of Whiteinch.

SOW had held an 0-licence in the North Western Traffic Area for 20 vehicles and 50 trailers, which was revoked in November 2008.

Samson was previously employed as a transport manager on a licence held by JAS (South Wales), which was trading as Smiths of Whiteinch.

That licence was revoked because the sole director, John Smith, was disqualified for holding or obtaining an 0-licence by DTC Richard McFarlane at a public inquiry investigating J & C M Smith (Whiteinch) in August 2006.

Traffic examiner James Sweetin said that KDC hired vehicles from BRS

from November 2007, operating them under the licence held by SOW, but latterly five vehicles had not been specified on any 0-licence.

KDC paid the rental charges and paid and instructed drivers. The examiner considered that the SOW licence and transport operation had been used as a front to conceal KDC's business activities. He believed this was an example of the buying of companies that had 0-licences and then moving on.

The TC was in no doubt that this was the latest attempt by Donnachie to find a way to operate goods vehicles. Using KDC, he was operating vehicles in the Strathclyde area for at least 18 months without an 0-licence for KDC or himself.

He used SOW as a front for his activities and to deceive hiring companies such as BRS. SOW was used as a means to get an 0-licence and, thereafter, any regulatory compliance was abandoned, leading inevitably to the revocation of that licence on assorted grounds.

The connection with Smith of Whiteinch was in Donnachie having been a director of that company, thus there was a thread between persons both human and corporate.
