• Hauliers facing prosecutions for overloading should check up on the accuracy of the weighbridge, says an operator who has had charges against him dropped.

Scottish timber haulier Archie Ferguson has been told that an overloading prosecution against his firm is to be withdrawn after he showed the court a letter from the Vehicle Inspectorate. It says that the VI would not prosecute unless the weighbridge code of practice had been strictly followed.

Ferguson, owner of Inverness-based Ferguson Transport (Spean Bridge), had appealed twice, eventually to the High Court, after being prosecuted as a result of a weighing of one of his vehicles at Ewloe, North Wales in 1994.

His case is now to be referred back to a magistrates court and he has been told no evidence will be offered.
