A SUBMISSION that if a haulier lost

a principal customer it was a mitigating circumstance for changing the normal user of. an A licence successfully rebutted a British Railways' demand at Aberdeen, on Tuesday, that the renewal of a one-vehicle licence held by Mr. S. Efficock, Aberdeen, should be refused.

Mr. Ellicock's original normal user was' general goods and furniture within 25 miles of Aberdeen," but in May. 1955, after the loss of his principal customer, he started to carry for C. W. Davidson, Mugiemoss Mills, Bucksburn, over long distance (The Commercial Motor, January 2).

Mr. J. H. Wilson, Davidson's transport manager, said Mr. Ellicock had worked for his company since 1955, when they gave up 15 vehicles and three trailers on C hire. The work was now done by A-licensed hauliers, together with three

vehicles on contract. Backloads were available from associated companies, amounting to up to 75 per cent, of the outward traffic.

Replying to Mr. R. R. Taylor, Q.C., for the railways, he agreed that they could have got other hauliers besides Mr. Ellicock in 1955. But it was new work which the railways could not do.

Mr. Taylor submitted that. there were no mitigating circumstances for the change of user; the vehicle had been used for three years in complete violation of the stated user.

Mr, W. Brown, for Mr. Ellicock, said renewal was sought for a vehicle and trailer—the sole means of livelihood for the applicant and his son. A material departure from the normal user was admitted, but Mr. Ellicock had no control over the actions of his previous principal customer, and had been compelled to seek new work. A full disclosure of the change was madeon renewal.

Granting the application, the Scottish Deputy Licensing Authority. Mr. Alex Robertson, said he. must have regard to the gross irregularities committed. The use of the trailer would be suspended for four months from February 1.

BUS INQUIRY PLANNED AT GLASGOW

THE working of Glasgow Transport Department is to be reviewed at a special meeting of the transport commit

tee, it was decided on Monday. At present the undertaking is faced. with an estimated deficit of £700,000 due to losses on trams.

Cllr. James Bennett, convenor of the committee, said at Monday's meeting that the recent award to craftsmen would cost them £26,000, and they had to meet the £250,000 award to bus crews. The problem was that outside 'peak periods the traffic was not there, although services had to be maintained, • Clfir. G.
