Which of the following most accurately describes the problem?

• Two ferry operators accused by the European Commission of illegally fixing a freight surcharge are set to appear at Brussels next month in an attempt to clear their names.

Brittany Ferries' Truckline and French-owned SNAT are expected to argue at a hearing on 6 March that they did not collaborate with each other and with three other ferry companies over a 10% freight surcharge introduced in November 1992.

The Freight Transport Association, which originally complained to the Commission over the incident and prompted its inquiry, has yet to decide whether to attend the hearing. The other ferry operators, P&O European Ferries, StenaSealink and North Sea Ferries, are not expected to defend the allegations at the hearing.

The Commission, which has issued a formal Statement of Objection against the five which accuses them of breaking the law by collaborating on the timing and size of the surcharge, is expected to make its decision against the five within six months. Those found guilty will be fined.

Providing the ferry companies do not appeal, hauliers can then sue for compensation from the companies through the UK courts (CM 10-16 November 1994).
