O-licence revoked for lack of finances

TRAFFIC commissioner (TC) for Wales Nick Jones has revoked the O-licence of Colwyn Baybased AW Lloyd for lack of financial resources.

At a July 2012 public inquiry (PI) in Wrexham, the TC was told how the boss of the business, Andrew Winston Lloyd, was granted a restricted O-licence in 2004 with authority for three vehicles. The TC temporarily suspended the firm’s licence at a PI in July 2011 and said it had to audit at least one driver’s daily walkaround check on a weekly basis; have rolling road brake tests at least every three months; and submit evidence of financial standing with accounts in the name of the operator within six months. Lloyd had produced evidence of finances in the name of another entity, but the TC made it clear to him that finances had to be in his personal name.

Before the latest PI, the TC asked Lloyd to produce evidence of his finances by the start of July for analysis by the TC’s staff. However, he did not provide it.

Lloyd had also failed to comply with the undertakings relating to walk-around checks and brakes.

Jones said: “Aside from the financial issues, the failures identified in the one audit report produced would have resulted in regulatory action, but it would have been an outcome that fell short of revocation of the licence.”

TC was concerned

The TC said he had concerns regarding the ongoing failure to adhere to the undertaking to produce finances in the operator’s name as agreed a year ago.
