Which of the following most accurately describes the problem?

• The identity of a TNT divisional manager was kept secret at a Licensing Authority hearing for "security reasons", TNT was granted licence authority for a new depot near Rotherham to extend its newspaper distribution network despite residents' fears of disruption by pickets_ The company was not responsible for the intrusion of unlawful pickets, the anonymous TNT manager told North Eastern deputy Licensing Authority Norman Moody.

Following opposition to the licence from residents and Bramley Parish council on environmental grounds, the LA granted TNT permission to base 55 vehicles and ten trailers at the Hellaby Industrial Estate, Michael Cunningham for TNT argued that the proposed site was eminently suitable, being located on an industrial estate adjacent to other trans port firrns and close to the M18 motorway.

The parish council was held to have a valid representation as owner of a nearby hall. It maintained the residents and users of the hall were suffering adverse effects from noise and fumes from vehicles queueing to get out on to the main road. The amount of traffic along the main road made it difficult for residents to cross and residents had been affected by parked vehicles and the general disturbance.

Granting the application Moody said the parish council had failed to show that it was adversely affected. lie accepted that one resident was affected by noise and fumes and had been disturbed by some disorderly people demonstrating for industrial purposes. However it had not been proved that residents were adversely affected by anything corning from the operating centre.
