Which of the following most accurately describes the problem?

• Aquitane Travel of Northwich, Cheshire has retained its PSV operator's licence following the resignation of a director who had been convicted of attempting to steal an 0-licence.

North West traffic commissioner Roy Hutchings had been considering whether the company still met the requirement to be of good repute following the conviction of John Haydock who was fined 21,300 and given a three month suspended prison sentence.

For the company, John Bacldiouse said that in view of the convictions Haydock had resigned as a Director. He is now a minor shareholder with no power to influence the company's activities. Even if Haydock and his wife, a fellow shareholder, together they could not out vote the other shareholder, Mr Beardsmore, who had been the CPC holder all along and unaware of the incident until after it had occurred.
