TIPROLL LTD, civil engineering contractor, which had run its business from a large private house for more than 16 years, was granted renewal of its 0-licence for five vehicles, at Birmingham on April 14.

Renewal had by North Borough Council grounds that the centre been opposed Warwickshire on the operating was unsuitable and that no planning permission was in existence. The council failed to turn up to sustain its objection. The company's managing director, Mr K. W. Ireland, said originally planning permission was obtained to operate for a three-year period. Renewal had never been applied for but the use of the premises had never been questioned until now.

In fact, the local authority had regularly renewed the licence for the storage of petrol and diesel at the premises. The vehicles were used solely in connection with their own business.

Maintenance was carried out by a commercial garage and the drivers took their vehicles home at night but did not park 'them on the public highway.

He personally, made periodic checks to ensure there was no parking in the street; this procedure had been carried out for a number of years and there had been no complaints from local residents.

Mr Michael Carless, for the company, said that he considered it doubtful whether planning permission was required for an operating centre in view of the existing use.

Granting renewal, the LA said he had a satisfactory maintenance report. On the other hand, he found it disturbing that the drivers were taking their vehicles home as this was an unsatisfactory practice. However, he was reluctant to disturb arrangements that had been in force for many years and did not propose to enter into the planning aspects.
