THE DEPARTMENT FOR Transport (DfT) is considering the implications of a European Commission (EC) statement which says some truck rental drivers' journeys will fail outside the driver's hours regulations.

Following questions from the Freight Transport Association and other European agencies, the EC has issued advice to local enforcement agencies about drivers who are not engaged in the carriage of goods.

The hours rules apply to drivers engaged in the carriage of goods or passengers. But the EC has now advised that in some circumstances drivers for truck rental companies are not transporting goods or passengers so would fall outside the scope of the regulations. The EC suggests these circumstances would include 'internal' trips, such as moving a vehicle from one depot to another.

The EC adds that member states could extend the exemption to other transport operations, vehicles or drivers not explicitly covered by the hours regs.

The FTA declined to comment, but has asked the DfT for clarification.
