AN UNLICENSED OPERATOR who mistakenly believed he was operating under the margin belonging to a licence held by a contractor must wait to learn if his truck will be returned. Stephen Doherty, of Lime Street, Stockport, appeared before northwest deputy traffic commissioner Patrick Mulvenna at a Macclesfield inquiry.

He was seeking the return of the vehicle, which had been impounded on 29 October in Birkenhead.Traffic examiner Colin Rowlands said the vehicle had been stopped in a check while driven by Doherty's brother Darren. It was displaying an 0-licence disc for a different vehicle in the name of Gerald McKenna. Darren Doherty said he was workir for McNicholas, of Garston. and that was being used under the margin on th; firm's licence. However, Rowlands said I was contacted by McNicholas' transpo manager, who stated that the vehicle w; not being operated under its licence at that it had subcontracted work to Steplic and Darren Doherty.

Stephen Doherty said that until Octohl they had not realised the importance 1 having an 0-licence, believing that 11 most important things were safety at insurance. VOSA had found the wagon I be faultless, he added.

He claimed the McNicholas area managl had said they would have to provide the with an 0-licence to keep the vehicle Garston; a claim that McNicholas denied.

Doherty now realised he was at fault ar had now applied for an 0-licence. He hi been under the impression that you hi to have more than one vehicle before yc needed to get an 0-licence.

In reply to the DTC, Doherty said ti vehicle had been purchased from McKem in September and the licence disc had been the windscreen when they bought it.
