WEST MIDLANDS Traffic Commissioners' refusal to delay their decision placing age limits on Staffordshire independent Berresfords Motors' fleet pending the outcome of an appeal by the company has been overturned by Transport Secretary David Howell.

Rather than revoke the cornpany's psv operator's licence the commissioners specified the maximum number and age of buses to be operated, and this meant that the six oldest vehicles in the fleet could no longer be operated. (CM December 12,1982).

Berresford has appealed, and when the Commissioners refused to stay their decision, appealed directly to the Government. As a result, Mr Howell has ordered the decision to be set aside until the appeal has been determined.
