After Mr Crabtree had said that it was very expensive to operate a lorry these days, Mr Derry said that he felt he needed to earn about £800 per week and he was satisfied he could do that. He produced figures of his earnings over the last eight months. He said that he had bought his vehicle, which was paid for, from Howards and he was buying his house on mortgage.

Mr Crabtree said he felt that Mr Derry's finances were sufficient for a limited licence for one vehicle for one year. In reply to Mr Crabtree, Mr Derry said he was the holder of a certificate of professional competence and William Howard was going to act as his transport manager. He operated from Howard's yard at Burton and Howards supplied him with work. He agreed that Mr Howard worked for Howards Transport.

Mr Crabtree said that in that case Mr Howard co-uid not be Mr Derry's full-time transport manager. Mr Derry had to be either professionally qualified himself or employ a full-time transport manager who was. It was not common sense for an ownerdriver to have a full-time manager.

There had been several attempts by people to get round the Regulations but it could not be done. Mr Howard was the boss of Howards Transport, so he could not work full time for Mr Derry.

Mr Crabtree said that Mr Derry was obviously an industrious and hard-working young man. He would like to give him every assistance, but he could not as the law required him to refuse the application.

Mr Crabtree warned Mr Derry that he would have to alter the basis on which he was working. The only way was for Howards to employ him. He suggested that Mr Derry take a course to become qualified, saying that the CPC exam was not a difficult way.
