• The Transport Tribunal dismissed this week the appeal of P. H. Evans and M. Whittall, of Astley, nr Shrewsbury, against the decision of the West Midland LA to revoke the company's six-vehicle licence.

Mr J. C. Anderson, representing the firm, said Mr P. H. Evans had not attended the Section 69 hearing because on the day he received notification of the hearing he failed to note its contents as he was attending the funeral of one of his drivers.

Mr Anderson explained that Mr Evans's business was concerned with plant hire, demolition, fertilizer spreading and he needed at least one vehicle for the fertilizer part of the business; he hal three months of unfilled orders.

The Tribunal dismissed the appea stating that the contract with Kenning had clearly been made solely for th purpose of this appeal, and reasons wilt the letter from the LA had not been re,a were not accepted. The LA was quit justified in revoking the licence on th evidence before him of a GV9 and in adequate facilities.
