A TRAFFIC COMMISSIONER has rejected 0-licence applications from two Scottish haulage firms. expressing concern about the "significant overlap" of directors and staff.

In a written decision. deputy TC for Scotland Tom Macartney, said Laura Powell, sole director of Pentland Commercials. and Darlene Bella director of B Kennedy Com mercials. had "very little knowledge about, and no experience in, the haulage industry" , having previously been employed as social care workers by East Lothian Council.

Macartney said he was concerned the companies intended to use the same operating centre Kerrycrusach, Dunfermline and had both failed to satisfy the requirement to be of good repute as well as have the appropriate financial standing requirement.

The TC added that "on the balance of probabilities" the Pentland application had been "a phoenix application on behalf of Brian Kennedy-. an individual who had seen a previous 0-licence bid fail following public inquiries in May and July 2009.

"Miss Powell knows less about her own company than any director of any haulage firm I have met in my professional career as a Traffic Commissioner," Macairtney added.

Al the inquiry. Powell denied any link to Brian Kennedy.

Macartncy also found that B Kennedy Commercials had f to satisfy the requirement tc professionally competent to an operator's licence".

Speaking about Bell. Macai said: "She did not have a Iran: manager and did not have ex ence in running transport. Stu no idea how much she would] transport manager. nor had any idea of the hours that v be required of a transport mar for her firm.
