A GROUP OF Polish truck drivers are taking a Dutch haulier to court because it paid them less than the Dutch minimum wage.
The drivers say they were hired by the Polish subsidiary of Gebroeders Huybregdst late last year to work in the Netherlands, but were paid at the Polish minimum wage because they were recruited by the firm's Polish subsidiary The Polish drivers are expected to argue that the Polish subsidiary was set up simply to avoid the higher Dutch minimum wage. and that they should have been paid the higher rate.
The subsidiary is based at Opole in south-west Poland. The Dutch minimum wage is €15/hr while the Polish equivalent is €3/hr.
An International Road Transport Union spokesman says the legal implications of 'posting' workers from one European country to another are extremely complicated. "It is being much debated in Europe at the moment, but we couldn't comment on individual cases," he concludes.
