Dismissal of Numerous Summonses on C.M.U.A. Defence.

Alderman Sir William Dunn, at the Police Summons Court (Guildhall), on Tuesday, the 12th inst., had before him Stanley George Mortimer,. to answer a summons for driving a steam motor engine, with trailer attached, without, having two effective independent brakes. Mr. Alfred Cecil Marsden, owner, was summoned for permitting the vehicle to be so used.

Police evidence was given to the effect that Mortimer when pulled up, said, that in addition to the one brake his engine was fitted with reversing gear.

Mr. Dean (C.111.1..120, defending, remarked that there had in the past been great difference of opinion on the subject as to whether the reversing of the engine could be counted as a brake ; some Courts had decided in one way, and some in the other, until, on a decision of the Divisional Court, the Local Goveinntent Board had been approached by the C..M.U.A., and an Amending Order had been annexed to the Act, it being held that the reversing of the engine, and an efficient brake, complied with the provisions. Sir William, on this point, dismissed the summons, others of a like nature being withdrawn by the police.
