Which of the following most accurately describes the problem?

A NORTH WALLS partnership given 14 days to produce proof that a partner held a CPC. has lost its licence. In addition, Welsh Deputy Traffic Commissioner Simon Evans disqualified Corwen-based Anne and Edward Edwards, trading as AJ Edwards, from holding an 0-licence for six months.

The DTC was told that some inspection records were missing and others were incomplete; vehi cies were not being inspected at the stated interval of six weeks; the failure rate at annual test was 83.3% and S-marked prohibitions were issued to a vehicle and trailer in October. Also, an undertaking given at a previous public inquiry to have roller brake tests four times a year had not been complied with.

Edward Edwards had been driving a vehicle that had a 30% overload on the front axle in May 2006. The partnership and one of its drivers were convicted at Conwy Magistrates' Court in February 2006 of a number of offences, including not using a tachograph when required.

There were two further driver prohibition notices concerned with tachograph failures in November 2008 and January 2009.

CPC holder Anne Edwards said she did not take any part in the business and that Edward Edwards thought he was a CPC holder.

Revoking the licence with effect from 9 June, the DTC said he was not satisfied that real progress had been made since a public inquiry in 2005. In effect, the same issues, which were related directly to safety considerations, remained. He was most concerned by the seri ously dangerous condition of the tyres to both the vehicle and trailer that had led to the S-marked prohibitions in October 2008.

No material had been produced to show Edward Edwards held a CPC. That said, the DTC would not have regarded him as such a professionally competent person, even if such evidence had become available.
