Which of the following most accurately describes the problem?

THE Transport Tribunal has remitted to the West Midlands deputy LA a case in which the operator's licence of H. V. Patel, trading as Bidwalla and Co, was revoked after allegations about a new partnership were made. The deputy LA made his decision when Mr Patel was not present and decided to revoke the licence on the ground that there had been a material change in the circumstances of the holder of the licence.

Mr Patel told the Tribunal that there had been no partnership but the Tribunal held, that as it was unaware of what material the deputy LA had before him, that the case should be remitted. The appellant would then have a chance to put forward his case.
