• It is no excuse to talk about "operational defects"— the law does not distinguish between operational defects and others, emphasised North Eastern Traffic Commissioner Keith Waterworth when Goole tipper operators Peter and Shaun Trewariha, trading as P Trewartha & Son, ap-Deared at a Leeds disciplinary inquiry. Waterworth said any pro libition notice gave a IC power to take action. Vehicle examiner Peter Moses said eight immediate and five delayed prohibitions had been imposed in the past five years, 11 since a previous public inquiry in June 1994 when the licence was cut from 10 to eight vehicles. In October he issued one delayed prohibition. Moses said he accepted that a lot of the prohibitions were down to the workload. Peter Trewortha said the problem was the type of work. The vehicles were inspected every fortnight and checked over every night. £1,000 a week was spent on the vehicles. Asked what he was going to do to prevent defects arising, Trewartha said that some were unpreventable.
Hodgson said the prohibitions did not fall into a pattern and there was some doubt whether they were maintenance related or not. Waterworth suspended one vehicle for a month.
