Which of the following most accurately describes the problem?

• Two driving offences of exceeding the 4% hour limit have cost Stockport lorry driver Ian Machan £875. Machan failed to appear and the town's magistrates convicted him in his absence.

John Heaton, prosecuting for the DOT, said the drivers' hours regulations were there for the purpose of road safety, ensuring that tired drivers were not behind the wheel of heavy goods vehicles.

Traffic examiner Duncan Pimblott said that a vehicle belonging to G Beeson & Sons driven by Machan was stopped in a check in June.

An initial examination of Machan's tachograph charts revealed several offences of exceeding 4% hours driving without taking 45 minutes rest On 2 June he had driven for eight hours and 10 minutes without a break after 4% hours.

The chart for 5 June showed some nine hours eight minutes drivingtime. The only break was one of eight minutes.

The magistrates fined Machan £400 per offence and ordered him to pay prosecution costs of £75.
