• The wife of a former director of Faringay, now in liquidation, has succeeded in obtaining a licence for 12 months following a two-day public inquiry before North Eastern Deputy Traffic Commissioner H Anthony Richardson.

Glenda Kelly, of Scopsley Lane, Shipley had applied for a new national licence for two vehicles based at the Anglo Coal depot at Woodlesford. Her husband John Kelly was nominated as the transport manager. The Commissioner had a letter from a fuel company complaining about money owed by Faringay.

Richardson said John Kelly had previously been involved with Faringay. Poor maintenance led to the company's licence being cut from eight vehicles and two trailers to three vehicles and one trailer in April 1991 and the duration was cut so that the licence expired in March 1992. The company did not renew its licence.

In August Kelly was seen delivering coal in Batley, using a vehicle displaying a Faringay licence disc, though that company no longer had a licence. That was a serious matter, as the vehicle was being used illegally.

John Kelly said the financial situation had made it impossible to carry on as Faringay following the loss of a contract with Cory Coal. Anglo Coal had said it could find work for one wagon, and his wife submitted an application for a licence.

They had been caught in a situation where if he had not kept up with the work the contract would have been lost.

Richardson granted the licence for what he described as a probationary period. After hearing financial evidence in private, Richardson said that he would want to see full accounts for the year ending 30 September before considering any licence renewal application.
