Which of the following most accurately describes the problem?

• A well-known South Wales company of steel stockholders and structural engineers appeared before the South Wales LA in Cardiff last week under Section 69.

Connies of Cardiff which holds a licence for four vehicles and three trailers with a margin of one vehicle and one trailer had notices of immediate and delayed prohibition placed on three of its vehicles between November 21 and December 3 last year.

Appearing for the company Mr Alexander David Foster, director, said that inspection and maintenance was carried out by staff fitters and records were kept of faults and work done to put these right.

"Unfortunately, that is where we appeared to be at fault — we have not kept records of routine maintenance when no repairs or maintenance was necessary," said Mr Foster.

The company had now entered into a

contract with Transport Engineering Services to maintain and inspect all vehicles from January 1,1972.

Maintenance records were produced to the LA dated from 1968 and Mr Ronald R. Jackson, the LA, remarked that when On C licences detailed vehicle inspection reports were being kept.

"If you had continued with your previous method which was quite satisfactory, you would not have found yourselves before the LA now", said Mr Jackson.

Imposing a suspension of one vehicle for three months and deleting the margin held, the LA said he could not overlook the fact that the company gave an undertaking when the operator's licence was granted that maintenance would be carried out. The present licence expired in October 1973 when a further inspection would be required and it would depend on the outcome whether he would grant a renewal.
