N The first company to have a :ruck impounded by the Vehicle nspectorate has failed in a bid :o get the vehicle back.

South Eastern & Metroiohtan Traffic Commissioner ;hristopher Heaps rejected the weal of Essex-based Manzoor lussain, whose Leyland Oaf tipler was seized on 22 January allowing a roadside check.

The vehicle was found to be verloaded and enquiries evealed that Hussain did not old an Operator's Licence so is tipper was detained.

Hussain had two previous onvictions for operating vehiles without an 0-licence in ugust and September 1998

and vehicles belonging to him had been found running without 0-licence discs on two occasions last year.

Hussain admitted using the vehicle concerned and said that he had no real explanation for operating illegally but was "very sorry". Heaps said: "I have no hesitation in concluding that there are no grounds for the return of the vehicle."

The truck will now be either sold or destroyed.

The second vehicle to be seized, operated by City Waste Management, is on finance and the finance firm has launched an appeal.

Since then two more vehicles have been seized: a truck owned by Chester-Le-Street scatfolder Roy Middleton was impounded on 7 February and Liverpool skip operator Jack Jones lost his truck on 8 February. Both operators have 21days to appeal.
