THAT an application by Mr. Thomas McLean, haulier, 171, Seagate, Dundee, for a B licence for a lorry, or for a licence for discretionary tonnage, was a deliberate attempt to seek relief from an open application for a new licence, was the opinion expressed by Mr. H. Riches, Northern Scotland Licensing Authority, at Perth, last Friday. . •

Tne application was in the form of a request for the transfer of a licence formerly held by Mr. Herbert Deuchars, 159, Ifilltown, Dundee, whose business the applicant said he had acquired in November. He had paid £30 for it and admitted that the stock-in-trade consisted of two canvas covers and three petrol tins. He had previously bought the business of Messrs. Hay Brothers, Dundee, taking over the hire purchase contracts of two lorries. Mr. Riches referred to tte fact that Mr. Deuchars had given up his licence in August and had later indicated that he was acquiring another vehicle, but neither of these vehicles was the one for which the applicant sought the licence. The application was, therefore, out of order.

In respect of his application for discretionary tonnage; Mr. McLean said that since taking over Mr. Deuchars' customers, he had had difficulty in executing orders and had had to refuse loads. He denied that the reason for other contractors refusing to hire vehicles to him was the uneconomic rates which he charged.

The Authority refused both applications.
