Which of the following most accurately describes the problem?

AN OLDBURY-based company has had its licence authority cut for the second time in two years because of maintenance problems.West MidlandTrallic Commissioner David Dixon decided Pearldrive did not deserve to lose its licence because some improvements had been made; instead he cut the authorisation from two vehicles to one indefinitely.

The company was called before the TC because of concern over maintenance, hours and tachographs. DTC Lester Maddrell cut the authorisation from two vehicles to one for one month in May 2005 because of similar problems. In September 2006 the company was convicted of three sample offences of failing to use a tachograph and fined £600 with £148 costs.

When it first came before the TC in June he was told everything was now in order and adjourned the hearing for further checks.

Vehicle examiner Peter Handley said a vehicle had been given an immediate prohibition at the roadside for three braking defects. He carried out a maintenance investigation in July and inspected one vehicle, finding two advisory defects.

The inspection records were now correctly corn.. pleted but there was still no forward planner.

Traffic examiner Robert Lees said he visited the company in July and obtained 93 tachograph records. They showed 28 instances of drivers failing to use tachograph records and one of a driver breaking the 41/2 hours rule. A driver implicated in 26 of the cases said he removed the tacho chart when taking breaks.

Director Satwanda Sanghera had said they did not check breaks and had not picked up discrepancies. There were now no missing records and records were better completed but the discrepancies were disappointing. He now had a better understanding of how to check tachograph charts.
