Middlesbrough-based Bulmers Logistics (Mahon) £1,000 in fines and costs after it admitted the offence when it appeared before Epping magistrates.
Prosecuting for Vosa, Anthony Ostrin said that when a 3+3 artic belonging to Bulmers was checked at the roadside it was found that the weight on the compensated axle bogie exceeded the permitted weight of 24,000kg by 2,650kg (11%).
Bulmers said it had not appreciated the overload; given the payload and gross combination weight it did not believe the axles had been overloaded.
Ostrin said the arties tank container had been loaded with 29,000 litres of chemicals as near to the gross weight of 44,000kg as the trailer would take.
Appearing for the company, Gary Hodgson said its MD was on the board of the Road Haulage Associa tion and was well aware of the need to ensure that the company complied rigidly with the regulations. This was an unusual weight distribution problem; little liability should be attached to the company.
Fining the company £500 with £500 costs, the magistrates said they felt that the axle overload could have been foreseen.
