The Tribunal shared the OTC's belief that the CPC holder had failed to exercise proper control over his operation. Hours offences, prohibitions, a driver's conviction and a failure to carry out undertakings led to this conclusion. TCs are obliged to take action if they believe serious safety issues are at stake.
