Tribunal upholds Licence refusal decision

THE TRANSPORT Tribunal has upheld the refusal of a new international licence for 10 vehicles and 10 trailers by Doncaster-based BSL Logistics. The bid had been rejected by North Eastern Traffic Commissioner Tom Macartney on financial grounds, and the company had appealed.

In a letter in September, the Traffic Area Office pointed out that documentation was needed showing the company had £36,800 readily available. This could be shown using three months' bank statements, evidence of an overdraft, or credit card statements that showed the firm had access to the required amount.

It appeared the funds to be used were sourced from the personal account of the managing director, so an opening bank statement in the company's name that showed it had access to the required amount was needed.

The managing director wrote back, acknowledging the letter and indicated there was no problem in meeting the request for the suggested financial documents. However, no details were supplied about opening a bank account in the company's name. Following a telephone conversation, the managing director wrote again stating he had not seen the September letter and had arranged a meeting with the bank manager to discuss an overdraft.

He added that while wanting to comply with the Traffic Area's request, he was unable to do so at the present time. He went on to suggest his own personal account statements should be accepted as demonstrating sufficient financial standing on behalf of the firm.

No surprise

The Tribunal was was not surprised the TC acted on the company's statement that it was unable to comply with the Traffic Area's requests. It noted the company had written specifically acknowledging receipt of the TA's September letter.
