Which of the following most accurately describes the problem?

Owner/hirer of vehicle

• Vehicle fitted with adequate security devices and well maintained. System in place which, if operated properly, would comply with code of practice. Instructions given about existence of the system, but no training or compliance monitoring given. Unable to demonstrate system is generally operated well, but previously good record of liability to penalties.

Penal!), at lower end of scale.

• Owner provides vehicle with no security devices. No system in place and no instructions to driver on measures to prevent stowaways. Owner has poor record of liability to penalties. Probably maximum penalty.

Driver of vehicle

• Provided with vehicle with inadequate security, no instructions from vehicle owner about preventing stowaways. Doesn't leave vehicle unattended at any point unless necessary. Carries out checks before embarking for the UK; 15 minutes before boarding ferry submits vehicle for a carbon dioxide check and has receipt for that.

Good record for liability to penatties. If suspicious, turns back to port once in UK and reports to authorities. Has asked vehicle owner to provide adequate security and pointed out vulnerability of vehicle.

• Vehicle has adequate security, driver given instructions about preventing stowaways. Fails to use any security devices provkied, neglects to carry out checks and does not submit vehicle to third party checks before embarkation. Poor record of liability to penalties.

Probably maximum penalty.
