FAILING TO use a tachograph, knowingly making a false record and taking insufficient rest has cost Clacton-on-Sea driver Andrew Nightingale £700 in fines and costs.

Nightingale pleaded guilty to the offences before the Harlow magistrates.

Anthony Ostrin, prosecuting for VOSA, said traffic examiner Jeremiah Gleeson had inspected a three-axled Daf tractor unit towing a three-axled semi trailer being driven by Nightingale. On his chart for the previous day the rest period was only 8hr 6min in a 24 hour period; the regulations normally require 11 hours.

The chart produced for the day in question was void of any trace markings although the centre field had already been completed. No tachograph chart was being used at the time of the check and the chart produced was clearly false as the time driven had not been recorded on it, Ostrin explained.

Nightingale was fined £450 with £250 costs.
