A STRING of prohibitions has led to the temporary curtailment of a Scottish operator's licence, despite the company's decision to reduce its fleet and cease international work. However, the TC made it clear that the company's remedial actions had saved the licence from complete revocation.

Scottish Traffic Commissioner Joan Aitken suspended the licence held by Castle Douglas-based Ian Spencer for two weeks. Spencer had voluntarily cut his licence from three vehicles and four trailers to one vehicle and one trailer and downgraded it from a standard international to a standard national licence.

The TC said operators who get S-marked prohibitions, for serious maintenance defects, and are subject to adverse maintenance investigations need to act immediately to rectify deficiencies.

Vehicle examiner Robert Carson said maintenance was contracted out to a commercial garage with a stated inspection period of six weeks. Since October 1999 four immediate and two delayed prohibitions had been issued to Spencer's vehicles, three of which were endorsed S'.

There had been unsatisfactory maintenance investigations in December 2003 and July 2004. The maintenance system had not improved and Spencer was continuing to operate "unroadworthy" vehicles, he added.

Appearing for Spencer, Roger Colledge said the arrangement with the original commercial garage had come to an end and new arrangements had been made with another local garage which would be responsible for all safety checks and repairs.

The TC said that even after the intervention of VOSA Spencer had not been strictly adhering to inspection intervals and he had not been rectifying all the defects picked up by the inspections. He had been on clear notice that he had serious problems with the way he had been going about his operation.
