THE UNITED Road Transport Union (URTU) has taken its fight for an overhaul of LGV drivers' Working Time regulations to the Court of Appeal. It said that a "legislative oversight" in the Road Transport (Working Time) Regulations 2005 means drivers employed for less than a year can't lodge an employment tribunal claim if they are dismissed after complaining about working excessive hours. URTU said it won a commitment from the previous government to change the law, but that the coalition was playing "fast and loose" with the public's safety by refusing to introduce secondary legislation providing protection to individual drivers. In the summer it took the matter to the High Court, but its call for a Judicial Review was rejected. It has now lodged an appeal with the second most senior court, and has until the end of January to provide oral submissions in support of its claim.
