The Loughborough-based company appeared before the TC at a Cambridge disciplinary inquiry at which he was also considering the seven immediate and eight delayed prohibitions issued to the company's vehicles and trailers since September 1996.

Traffic examiner Chris Harris said that following a complain( about a vehicle being parked overnight in Luton he was told it was on a lease package with a Paul McMahon. Enquiries revealed McMahon did not hold an 0-licence or an HGV driving licence. He had admitted operating illegally between June 1997 and January 1998.

Sherwood managing director Alan Sherwood admitted he had known McMahon did not hold an 0-licence, but the company had continued to provide loads The company was also aware that subcontractors Keith Brown, of Middlesex, Robert Grignon, of Borrowash, and David Sherwood were also unlicensed, although David Sherwood had been operating for five or six years.

The company had previously pleaded guilty to aiding and abetting MCMahon, who had failed to appear before the magistrates: a warrant for his arrest had been issued by the Royal Ulster Constabulary; the company had been fined £500.

For the company, Ian Rothera said Brown and Grignon now had interim authority to operate. David Sherwood was driving a vehicle specified on the company's licence. To avoid doubt David Sherwood had now applied for an 0-licence.
