Which of the following most accurately describes the problem?

10ENSING Authorities, and transport advocates will, no doubt, be interested to hear the Transport Tribunal's interpretation of the words in the Act "the date of the application."

Sir Hubert Hull,. the President, said during the hearing of the recent appeal by J. Jacques and Son. Ltd., of Tufnell Park, that Licensing Authorities should take into account all evidence up to the date of the inquiry. •

He was told, during the appeal, that the Metropolitan Deputy Authority took the view that anything which happened after the date the application was signed and before the inquiry was held, was not material. Counsel for Jacques told the Tribunal that there had been a great deal of misunderstanding on this point and "those of us practising in the Area would be grateful for a ruling on the point."

(Prior to this, Mr. Muir. the Metropolitan Authority, in a long decision in which he granted Securicor (Southern), Ltd., 10 vehicles, ruled that the words "the date of the application" in so far as section 173(6) of the Act was concerned. meant the date on which the application form was received in the Area office.

Again. at Southampton, recently, the South Eastern Deputy was told that his superior took a similar view.)
