Which of the following most accurately describes the problem?

TRUCK MANUFACTURER BMC says a winding up petition wrongly issued last week by HM Revenue & Customs (HMRC) led to false rumours that the company was in trouble.

Speculation about the future of the low-loader business grew after HMRC bought an action against the irm regarding a purported outstanding tax liability involving VAT duty on goods imported from Turkey.

However, according to BMC, the action did not take into account that the debt was 100% refundable.

Last week a High Court Judge set aside the claim for two months, to give time to departments within HMRC to rectify the error.

BMC says that at no stage was it liable for the monies, other than it being a timing issue between two different parts of HMRC.

Paul Bicknell, marketing director at the company, conirms that BMC is still trading and has not entered into either administration or liquidation.
