Which of the following most accurately describes the problem?

• In renewing the licence held by Slaters Transport, Scottish Licensing Authority Hugh McNamara ruled that vehicles and trailers on a licence margin ought not to be taken into account in assessing whether a licence application would result in a real change in the use on an operating centre.

The Glenboig-based company had applied for renewal for the 25 vehicles and 60 trailers previously authorised, but reduced the application to 12 vehicles and 40 trailers during the public inquiry (CM 17-23 September).

The LA said that the representers had failed to show how the mischief they complained of was attributable to the company's vehicles. Consequently he had no option but to renew the licence, but he restricted the time during which vehicles could enter and leave the operating centre.
