• Cappull, Lanesbased haulier Carl Rigby and four of its drivers have been fined a total of £10,000 with .£350 costs, after admitting the falsification of tachograph records.

Wigan Magistrates had previously decided that the charges were so serious that they should be dealt with at Bolton Crown Court (CM 4-10 May). They were subsequently persuaded that their powers of punishment, with a maximum fine of £5,000 per offence, were sufficient.

Ronald Cartledge, of Bexley Close, Davyhulme, Manchester, pleaded guilty to five offences of falsifying tachograph charts, four of driving a vehicle without a chart in the tachograph, and four of insufficient daily mgt.

Mark Drummond, of Rufford Road, Crossens, Southport, pleaded guilty to six offences of falsification, six of running without a chart in the tachograph, and four of insufficient daily rest.

Michael Hooley of Bexley Close, Davyhulme, pleaded guilty to three offences of falsification, two of running without a chart and two daily rest offences.

Stuart Walsh, of Back Lane, Longton, Preston, pleaded guilty to eight offences of falsification, five of running without a chart, and three daily rest offences.

They were each fined £1,500 with £70 costs. Rigby, of Moss Cottage, Moss Lane, Leyland pleaded guilty to 25 offences of aiding and abetting the drivers to falsify tachograph charts, and 21 other related offences. He was fined £4,000 with £70 costs.

Diane Cooper, prosecuting, said that two of Rigby's drivers were stopped on the same day by PC Graham Robinson who saw that they had been running with the fuses out of their tachographs. When PC Robinson visited the firm he found that the other drivers were doing the same and Rigby was permitting them to do so.

Defending, John Backhouse said that the five men immediately admitted what they were doing when the investigation started.
