Which of the following most accurately describes the problem?

• The campaign by 14 drivers made redundant when AAH Holdings took over Barnfather is set to continue this month as they prepare to take AAH to another industrial tribunal.

This follows last week's ruling by a Newcastle-upon-Tyne industrial tribunal that AAH was the drivers' employer at the time of their redundancy. Unless AAH appeals the Transport and General Workers Union will try to proceed for the 14 against AAH alleging unfair dismissal and unfair selection of redundancy. AAH refuses to comment. The case surrounds last year's collapse of Barnfather and the subsequent purchase of most of the North-East haulier's assets by AAH. According to the union, when the men were made redundam they believed they were owned" by Barnfather although it transpired AAH had bought the assets.

AAH countered that the men were not in its employment at the time of dismissal.

Liquidators are investigating whether the transfer of assets and goodwill—but not the debts to AAH were knowingly undersold.
