SOUTH WEST TRAINS has issued a High Court writ claiming more than 1500,000 from a selfemployed driver whose truck was hit by a train on an unmanned level crossing more than two years ago.

The company alleges that the driver, Roger Wilshire of Worton, near Devizes, was negligent because he failed to call the signalman for permission to cross, drove very slowly onto the crossing and stopped in the train's path. Wilshire was on his way to a quarry to collect a load. Wilshire says he has been advised by his solicitor to say nothing, except that newspaper reports on the case "have had a grain of truth, totally spun out of proportion".

The accident happened at a level crossing near Tisbury, Wilts, on 2 July 2001. A spokeswoman for South West Trains says the /537255.95p it is claiming will cover the cost of damage to the train, a two-carriage Sprinter.

The High Court listings office says a date for the High Court case has not yet been lixed.
