Which of the following most accurately describes the problem?

• The managing director of a Barnsley haulage company was told that if its vehicle maintenance went awry in the future, personal assurances he had given at a Leeds public inquiry would come back to haunt him.

Hilloak was called before North Eastern Traffic Commissioner Keith Waterworth, who was also considering an application by the company to increase its licence authorisation from seven vehicles and seven trailers to nine vehicles and seven trailers.

DOT vehicle examiner Anthony Fielding told the TC that in June he examined six vehicles, issuing two immediate prohibitions. He said that one vehicle had two long standing defects; the other had a serious brake defect. There was no inspection pit; and inspection records were completed by managing director Alan Wright rather than the fitter.

Fielding added that the driver defect reporting system was not being enforced and six vehicles had been stopped in roadside checks since February 1993. resulting in three prohibition notices. But he agreed changes had since been made in the company's systems which had addressed the major criticisms.

Wright said that spot checks were now carried out to ensure that preventative maintenance inspections and drivers' daily checks were being properly carried out. He was satisfied that the company's maintenance was now in order and the fitter was satisfied with the workshop facilities. The increase in authorisation was to enable vehicles to be hired in at busy periods.

Waterworth granted authority for one additional vehicle but issued the company with a formal written warning. He required a review of the company's maintenance record within six months.
