Mark Clarke of East Ham, East London was sentenced to seven years at Southwark Crown Court in April after he was found guilty of theft and manslaughter. But when he appealed against the sentence, his lawyers successfully argued that his sentence was "manifestly excessive" because his older brother, John Clarke, had his nine-year sentence cut to seven and a half years on appeal despite having a much worse criminal record, Mr Justice David Clarke, sitting

with Lady Justice Smith and Judge Chapman QC, also heard that Clarke had never left the getaway vehicle and it was his brother who ran over truck driver Ian Jones. The judges cut Mark Clarke's sentence to five years but refused to cut a four-year driving ban that was imposed at the same time

The theft was committed in August 2003 in Chingford, Essex. As Mark Clarke waited in a stolen van, his brother attempted to drive off in Jones's truck which was loaded with electrical equipment.

When Jones, from Hawkhurst, Kent, attempted to stop John Clarke he was run over twice and suffered a heart attack at the scene before dying of his injuries.
