• The Freight Transport Association has slammed the decision by the London Boroughs Transport Committee to reject Blue Circle Industries appeal against mandatory fitting of air brake silencers to 18 of its vehicles (CM12-18 October).

The LBTC ruling was made despite the findings of its own Appeals Advisory Committee which said the Lorry Control Unit acted unreasonably in denying permits to the cement company. The AAC accepted Blue Circle's case that Condition 11 of the Ban should not be imposed as its vehicles rarely entered London.

The LBTC said that if the appeal was allowed other companies with large fleets could evade Condition II simply by arranging for individual vehicles to only operate occasionally in London. But Don McIntyre of the FTA says the decision "exposes the appeals system for what it is — a sham and a charade".

"There have been eight appeals against Condition 11. All eight have been rejected and the LBTC seems deter mined to ensure that none will succeed," he says. "This latest decision is an insult to members of the Appeals Committee who have been chosen for their skill, knowledge and expertise on transport matters. Clearly all that counts for nothing when their recommendations don't find favour with the LBTC."
