vehicle giving the highest possible payload without its driver needing an hgv licence. My first reaction was to sell him a vehicle giving a payload of 5 tons. However, it has been suggested to me that such a vehicle supplied for use with a drawbar trailer could be plated at 16 tons gross and still not require the driver to have an hgv driving licence, because for this requirement it is the unladen weight of the prime mover which is considered. Is this correct?

AYes, In the case of drawbar trailer combinations it is the unladen weight of the drawing vehicle which determines whether or not an hgv driving licence is required. If the rigid drawing vehicle has an unladen weight of not more than 3 tons. an hgv driving licence is not required even if such a vehicle is used in combination with a drawbar trailer.
