tion h Wincanton magistrates for permitting an offence concerning the hours of employment of one of his drivers. The magistrates had been told that one of his drivers had taken his lorry a distance of half a mile to his home during a compulsory rest period. Mr. Hicks was
fined for permitting this.
Mr. Flicks gave evidence that the requirements of the law were carefully explained to new drivers and that he checked the time sheets every week. He had no knowledge that this driver would visit his own home during the rest period.
Representing Mr. Hicks, Mr.
J. Cs. Hull said that until this year the driver concerned had had an unblemished driving record, and Mr. Hull told Quarter Sessions that Mr. Hicks had exercised all possible supervision over his employees.
In allowing the appeal the court granted costs to Mr. Hicks.
