Which of the following most accurately describes the problem?

• A judge has directed that the trial of Francis Newell and Paul Wright, partners in Sheffield based Newell & Wright, on charges alleging aiding and abetting the falsification of tachograph charts by the firm's drivers, must start on 3 October, come what may.

Newell, of Upper Whiston Lane, Rotherham, and Wright of Kiveton Lane, Todwick, Sheffield, are accused of aiding and abetting seven drivers and causing them to make false tachograph records.

The trial is estimated to last three weeks. It was due to begin on 14 March but was adjourned because defence counsel were unavailable. Fixing the October date, Judge Bullimore said the matter could not be allowed to drift on any further as it concerned events going back to the beginning of 1991. Counsel had between now and October to make sure they were available.
