It was refused, although it was pleaded that, had he been properly advised, he .could originally have obtained an A licence on claimed tonnage. Because he sometimes paid for a load of sand at the pit, on behalf of a customer, he had accepted a B licence with a 40mile limit and this restriction was now crippling his business.

Mr. A. H. Franks, director of A. C. Fields (Merchants), Ltd., Ardwick, Manchester, gave evidence that he wanted Mr. Davies to carry all over the country baths and miscellaneous loads of roofing. More baths were being sold in the south than in the Manchester area, To pack them in special crates, as required by the railway companies, under the international agreement, was not economic.

Mr. P. Kershaw (for the L.M.S. Railway Co.) said that there were 528 A and 573 B licences in the Manchester area, and there was no need for Mr. Davies to be given an extended radius of operation.

Mr. A. Clarke Storey (for the applicant) contended that an obvious error had deprived Mr. Davies of an A licence and that there was nothing in the Act to prevent an error of this sort from being rectified.

The North Western Deputy Licensing Authority, Sir William Hart, replied that Mr. Davies had been content with his B licence until A. C. Fields (Merchants), Ltd., wanted him to go farther afield. It was for himself and the railway company to confer to see whether they could agree upon the required extension of the B-licence facilities.
