• Although they dealt in the transport of race horses, the respondents were not going to gamble on the outcome of an appeal and would agree terms with the appellants, said Miss E. Havers, their counsel, at the Transport Tribunal on Wednesday.

Horse Transport Ltd. and The Direct Transport were appealing against the Eastern Licensing Authority \ grant of a new B-licence for a 6-ton four-horse tramporter based at Newmarket to Ridgeway Transport Ltd. of Milton, near Oxford.

Mr. R. M. Yorke for the appellants said race-horse trainer Mr. T. A. Corbett had moved his stables from the South Eastern traffic area into the Eastern, and Ridgeway wished to continue carrying for him. If this had not meant a change of traffic area, the matter would have been settled by a change-of-base application. But by the alchemy of the licensing system, a new licence was required and had met with objection since there was no evidence of increased demand.

However, if they agreed to reduce their total number of vehicles to its previous level, then the appeal was unarguable, he said.

Miss Havers said they would give an undertaking that within three months Ridgeway would remove a four-horse-box from the road in the South East. They had agreed so as to be sure of' having a horse

box for Mr. Corbett's use in Newmarket during the present busy season.

They held nine A-licensed and a Blicensed vehicle, the latter being for two horses. In order to arrive at the equivalent capacity it will be necessary to switch this vehicle from B to A and then apply ,,to upgrade it to a four-horse container, which would be subject to the usual publication, she said.

The appeal was dismissed.
